Acceptance of Terms

By creating an account or using Walnut Learning Assistant (“the Service”), you agree to these Terms of Use and the Data Processing Agreement (DPA), which together form a binding contract between you and Walnut.

If you are a parent or guardian, you accept these Terms and the DPA on behalf of your child.

Service Description

Walnut Learning Assistant provides AI-powered personalised learning support in subjects such as English, French, and Mathematics.

The Service is designed to be highly useful, but it:

  • May not always be accurate or error-free.
  • Should not be relied upon as a substitute for formal education or qualified teachers.
  • Is not intended to replace human educational interaction.

We encourage parents/guardians to remain actively involved in their child’s learning.

Eligibility

  • Children under 13 may only use the Service through a parent or guardian account.
  • Children aged 13 and above may create their own account, with parental permission where required.
  • Parents and guardians are responsible for supervising their child’s use.

Subscriptions and Payments

  • Pricing and subscription tiers are displayed on our website.
  • Subscriptions renew automatically unless cancelled before the renewal date.
  • Fees are non-refundable except where required by law.
  • We may update subscription prices from time to time. If this happens, we will give you reasonable advance notice (at least 30 days), and the new price will apply from your next billing cycle.
  • If you do not wish to continue at the new price, you may cancel before the change takes effect.

Acceptable Use

You agree not to:

  • Misuse the Service or attempt to access unauthorised data.
  • Upload, share, or request inappropriate content.
  • Use the Service for unlawful or commercial purposes without permission.
  • Interfere with or attempt to disable safety features, parental controls, or security measures.

Accuracy and Limitations of AI

The Service uses artificial intelligence to assist with learning. While we aim for high standards of accuracy and usefulness, AI-generated content may sometimes be inaccurate, incomplete, or inappropriate. We do not guarantee that all responses, explanations, or outputs will be correct, error-free, or suitable for every situation.

Parents and guardians should review their child’s learning activity and outputs as part of their educational oversight. AI tools should be used to support learning, not replace personal judgement or direct supervision.

Data Use and Consent

Personal data is collected and processed in line with our Privacy Policy.

Some data may be used to train and improve our AI models. Parents or guardians and children aged 13+ may withdraw consent for AI training use at any time without affecting access to core learning services.

You acknowledge that by using the Service, you also agree to the terms of our Data Processing Agreement (DPA), which describes how we handle, protect, and process personal data under UK GDPR.

Intellectual Property

All content, materials, software, and AI outputs remain the property of Walnut or its licensors.
You may use the Service for personal, non-commercial educational purposes only.
You may not copy, distribute, or resell the Service without written permission.

Termination and Suspension

We may suspend or terminate accounts if:

  • These Terms are violated,
  • Fees are unpaid, or
  • There is misuse or unlawful activity.

Parents or guardians may close accounts at any time through the parent dashboard or by contacting us.

Disclaimers and Liability

To the fullest extent permitted by law, Walnut is not liable for indirect, incidental, or consequential damages.
Our total liability in any 12-month period is limited to the subscription fees paid during that time.

Nothing in these Terms excludes liability for fraud or for death or personal injury caused by negligence.

Governing Law

These Terms of Use are governed by the laws of England and Wales.
Disputes will be subject to the jurisdiction of the courts of England and Wales.

Updates

We may update these Terms of Use from time to time.
If material changes are made, users will be notified, and the “Effective Date” will be updated.
